Court to Reexamine Decision That Permitted Trump to Send Military Forces to Oregon City
The federal appeals court has maintained a ban on deploying national guard in Portland, Oregon, after a latest legal decision.
Appeals Court Agrees to Rehear Legal Matter
The federal appeals court ruled on this week that it would rehear the case concerning the president’s authority with an larger panel of 11 judges. The court also overturned a previous decision from a three-judge panel that had supported the federal government.
Ongoing Dispute Over Military Presence
This order represents the most recent development in a protracted legal battle over whether the former president has the legal right and valid reason to deploy state military units in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was initiated in due to ongoing demonstrations.
Conflicting Arguments
The administration has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while local authorities maintain that local officers have command of the circumstances.
Contrary to characterizations of Portland as “war ravaged”, residents have been posting footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.
Recent Legal Actions
The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one preventing the federalization of the state troops, and another stopping the deployment of any national guard troops in Oregon, after attempts to circumvent the first order by calling up out-of-state forces.
On the previous day, the appeals court had temporarily suspended the initial decision – allowing command of state troops – but the second ruling stayed effective, blocking the physical sending of the troops.

The latest ruling means the matter will be heard by the full court – with all decisions under consideration together – by a group of 11 judges.
“This decision demonstrates that the truth matters and that the courts are working to ensure government responsibility. The constitution limits the executive authority, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a official comment.
“The judicial body is sending a definite signal: the president cannot send the armed forces into American urban areas unnecessarily. We will continue defending state legislation, principles, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
